1. Purpose of the privacy policy
Neon Design is committed to the right to privacy and makes every effort to ensure that all personal data is obtained, processed and used in a secure, reliable, ethical and transparent manner. Your privacy is important to us. We want you to feel confident that we will use your personal data both carefully and sensibly, in accordance with the principles of this Privacy Policy, which applies when you use our services and browse our website.
The purpose of this Privacy Policy is to tell you what personal information we collect about you, why we collect it and what we do with it. References to personal data in this privacy policy include any information that directly or indirectly identifies you, such as your first name, last name, e-mail address, telephone number, billing address, account number and previous “purchases”.

2. Who controls your personal data?
Neon Design nv is the controller of the personal data you provide to us and is responsible for processing your personal data in accordance with the applicable data protection legislation. Our head office is located at Essenestraat 22, 1740 Ternat, Belgium. Neon Design nv is registered in Belgium under company number BE 422 736 391.

3. How we collect and process your personal data
3.1.

Because data privacy is so important to us, we want to remain open and transparent about how we use your personal data. Neon Design will only collect your personal data when necessary in the context of our services.
Depending on your use of our services and our website, we may therefore collect, use and disclose (i.e. process) the following types of personal data about you: your contact details, such as your first name, last name, e-mail address, IP address and telephone number. We may also collect information on payments, credits and orders. We invite you to read the following sections to learn more about how we process your personal data.
Even though we are technically considered data controllers, the ultimate control of your personal data remains in your hands. If you provide us with proof of your real identity, you have the right to request access to a copy of the personal data we currently hold about you in a structured, commonly used and machine-readable format and to obtain information about the processing, including whether we are processing your personal data for profiling purposes. If you notice an error in your personal data, you can also ask us to correct the erroneous personal data or to complete your personal data. We will then notify all third parties to whom we have disclosed your personal data, so that they can ensure that your personal data is also fully correct in their possession. When technically feasible, you have the right to request that Neon Design transfer your personal data to another company of your choice.

According to the applicable data protection legislation, personal data may only be collected and processed on the basis of a limited number of legal grounds. At Neon Design, we rely on one of the following legal grounds to process your personal data:
- necessity for the execution of a contract with you (e.g. when you use one of our services);
- Legal obligation to which Neon Design is subject (e.g. when we process your payment details);
- legitimate interests of Neon Design (e.g. when we send you marketing emails about services similar to those you have already used);
- your express and informed consent (e.g. when you subscribe to our newsletters).
3.3.

Some of our clients like to receive newsletters to keep them informed of news about Neon Design. However, we understand that this is not the case for everyone. Therefore, the processing of your personal data for marketing purposes is based solely on your express prior consent. This means that we will never send you marketing communications if you do not appreciate it, unless you have already used one of our services.
If you wish to receive newsletters about our latest services, you can subscribe to our newsletters by e-mail via our website. In that case, we will process your e-mail address and your first and last name.
Once subscribed, you can object at any time to the use of your personal data for profiling purposes by Neon Design or by any of the third party recipients with whom we have shared your personal data, provided that we process your personal data based on our legitimate interests. If we process your personal data for direct marketing purposes, for example to send you newsletters, you have the right to object at any time to the use of your personal data for that purpose by contacting our Data Protection Officer (DPO) David Beeckman (david@neondesign.be). This does not involve any additional costs.
3.4. Information we collect internally
When you use one of our services, we may process personal data such as your name, contact details and limited payment details, as this information is necessary for the performance of the contract with you.
You may object at any time to the processing of your data. If we can no longer process your data, it will not be possible to provide you with the service or benefit that you claim.
4. How we protect your personal data
Neon Design is committed to ensuring the legal, fair and transparent processing of your personal data. Accordingly, we will only use your personal data if we have a valid reason for doing so and provided that you were informed in advance of the processing purposes, in particular at the time of collection of your personal data.
Furthermore, Neon Design ensures that any processing of your personal data is limited to what is necessary, appropriate and relevant for the purposes for which the personal data was collected. Whenever possible and technically feasible, Neon Design will use anonymised or pseudonymised data, e.g. for purposes related to our internal statistics and financial reporting.
Because we consider the protection of your personal data of paramount importance, Neon Design also pays great attention to the protection of your personal data and the systems in which they are stored. We have defined and implemented appropriate technical and organisational measures against unauthorised access, illegal use, accidental loss, damage or destruction. Thus, Neon Design is confident that your personal data will be processed on a strict ‘need to know’ basis, when and where appropriate and necessary.
We are fully aware that threats evolve and diversify and we would like to maintain your trust for a very long time. Therefore, we review and update our security measures and infrastructure so that we can mitigate operational risks and keep our security programmes up to date with the latest industry standards and best practices.
5. Outside parties with whom we may share your personal data
When relevant and necessary to the purpose of the processing activity, it may sometimes be necessary for us to disclose your personal data to other relevant organisations who need to know about it (so-called ‘receiving third parties’), based on our legitimate interest.
For example, in order to better understand your interests and preferences and to send you more relevant advertising, we may share your personal data with data analytics companies and advertisers based on our legitimate interests.
Any time your personal data is shared with third parties, it is subject to strict data processing agreements, with Neon Design remaining the data controller and the third parties involved acting as processors. Neon Design limits access and transfer of your personal data to reliable receiving third parties who can demonstrate an appropriate level of data protection. Furthermore, these receiving third parties must destroy or return all personal data to Neon Design after the end of the services related to the processing and must destroy existing copies, unless it is legally required to retain the personal data.
6. International transfer of your personal data
We do not transfer your data to countries outside the European Union or international organisations. These are countries or organisations located outside the territory of the European Economic Area (European Union + Iceland, Norway and Liechtenstein). We may do so if we use a cloud service provider. In that case, we will take all possible measures to ensure that your data is protected as stipulated in the European, federal and Flemish regulations.

7. How long we keep your personal data
As a general rule, Neon Design only keeps your personal data for as long as necessary to fulfil the purpose for which we originally collected it. However, those needs may vary for different data types in the context of different services. Therefore, actual retention periods may vary significantly. In addition, there are applicable laws and regulations that also lay down minimum retention periods for personal data.
Neon Design will always ensure that you are informed of the criteria used to determine the actual retention period and the underlying reasons for it. These depend on whether we process your personal data in the context of a contractual relationship with you or on the basis of your explicit consent, whether we process the personal data for your own legitimate interest, and whether Neon Design is legally obliged to retain the personal data for a certain period of time in order to comply with specific legal obligations.
8. How we delete your personal data
In certain circumstances, and provided that you provide us with proof of your true identity, you may exercise your right to request that your personal data be deleted and that we notify receiving third parties to whom we have provided your personal data of this request. Please note that this is only possible to the extent that the personal data is no longer necessary for the original purpose (i), if the processing was based on your consent and you have withdrawn it (ii) or if you have already objected to the processing on the basis of our legitimate interest (iii).
Except where we need to retain a copy of your personal data for statistical purposes, to initiate, exercise or defend legal claims, or to the extent we are required by law to retain a copy of your personal data, you can rest assured that Neon Design will either securely delete or permanently anonymise your personal data once we have fulfilled the original processing purpose and when it is no longer necessary to retain your personal data.
9. Your rights as a data subject
If you require further information or wish to exercise any of the rights mentioned above, please contact us (david@neondesign.be). We will do our best to answer your e-mail as soon as possible, and in any case within one month. If it takes us longer to fulfil your request, we will inform you and contact you again within two additional months. Neon Design will not charge you for this, unless we have already provided you with the requested information previously or unless it is unreasonably difficult for us to obtain the information. In that case, we will let you know the administrative costs in advance.
If you are not satisfied with the way we have handled your request, you have the right to request that our use of your personal data be restricted and to lodge a complaint with the supervisory authority responsible for the protection of personal data in your country of residence. Even though we sincerely hope that this will not be necessary.
Cookies
